CNN, MSNBC and Politico Sue Trump Administration Over White House Press Restrictions
In a significant escalation of tensions between the White House and the press, CNN, MS NOW (formerly MSNBC), and Politico are filing a First Amendment lawsuit against the Trump administration after being banned from White House press access. The lawsuit, announced Monday, seeks to restore their credentials and challenges what the outlets describe as unconstitutional restrictions on newsgathering. The ban was implemented after reporters were escorted off White House grounds over the weekend, though major television crews from Fox News, ABC News, CBS News, and NBC News were not affected.
The three outlets argue they are suffering “serious irreparable harm” due to the ban. In the lawsuit, they wrote: “They have already lost opportunities to perform their constitutionally protected newsgathering and reporting functions at the White House, impairing their ability to speak and publish as members of the press – and they lose more such opportunities every day that the ban remains in effect.” CNN was removed Monday from pooled coverage responsibilities, a rotating system shared by major news outlets. In a show of solidarity, the other major television networks declined to replace CNN’s White House pool crew. The five networks that make up the primary video pool—Fox News, ABC News, CBS News, CNN, and NBC News—issued a joint statement: “The public has a vital interest in receiving accurate, independent information about its government.”
The ban follows a steady campaign by President Trump and his allies to crack down on media coverage they deem too critical. Under Trump’s Federal Communications Commission (FCC), major broadcast networks have faced growing scrutiny over editorial coverage and commentary. The Associated Press previously sued over similar access issues, and that case remains ongoing. Trump defended the ban in a statement, saying: “In other words, almost without question and, as usual, we’ll go for appeal because Fake News people and publications that only write negatively, and who violate our National Security by writing false and defamatory stories with unknown ‘sources,’ shouldn’t be allowed access to the most important Office anywhere in the World.” The lawsuit underscores the ongoing battle over press freedom and the First Amendment in the Trump era.
