Prosecutors argue this constitutes a “true threat,” while Comey’s defense claims it is protected speech. The indictment, filed in the Eastern District of North Carolina, charges Comey with two counts under 18 U.S.C. for making threats against the president.
Comey has long been a central figure in debates over law enforcement independence, particularly after his handling of the Hillary Clinton email investigation and his firing by Trump in 2017.
